Complaints

Please note unfortunately we are unable to deal with complaints relating to the receipt of unsolicited text messages, silent calls or fax tones down the telephone.

Before completing the TPS complaints form, please read the following important information.

The Telephone Preference Service are happy to offer a complaint handling service as a value added service, however we are not the body responsible for enforcement and we are unable to take action against companies complained about. Complaints handled by TPS and Corporate TPS are included in a regular report sent to the Information Commissioner's Office (ICO). It is the ICO who are the body responsible for enforcement.

Unfortunately we are unable to take up complaints relating to:

• the receipt of unsolicited text messages
• fax tones down the telephone

However we are working closely with industry bodies and Ofcom to stop the nuisance of silent calls and fax tones down the telephone.

Registering mobile phone number(s) with TPS and CTPS will only reduce unsolicited sales and marketing voice calls. It will have no impact on reducing text messages. New legislation which came into force on 11 December 2003 makes it unlawful to send an unsolicited direct marketing SMS to an individual subscriber unless the recipient has previously given their consent to such communications. Corporate subscribers can explicitly request under the Data Protection Act 1998 not to receive unsolicited direct marketing SMS. Again the ICO's office is responsible for enforcement.
